These Terms and Conditions ("Terms") govern access to and use of the JobCardd.com website, web application, and companion mobile application (together, the "Service"), operated by Timetaag Software Pvt Ltd, trading as "JobCardd" or "JobCardd.com" ("we", "us", or "our"). By creating an account, logging in, or otherwise using the Service, you ("you", "User", or "Customer") agree to be bound by these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that organization, and "you" refers to that organization as well.
If you do not agree to these Terms, do not access or use the Service.
JobCardd is a job-card and service-management platform aimed at repair and service businesses (for example, mobile phone, electronics, and appliance service centers). The Service allows a business ("Tenant") to create job cards, track customer and device information, assign technicians, record services and pricing, generate stickers/labels, export reports, and manage the job lifecycle from intake to delivery, through the website and the companion mobile application.
The Service is multi-tenant: each Tenant's data is logically separated from other Tenants. We do not control, and are not responsible for, the accuracy of data that a Tenant or its staff enters into the Service.
2. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us promptly at the contact address below if you suspect unauthorized use of your account.
Tenant administrators are responsible for managing access of their own staff/technician accounts (System Users), including revoking access when an employee leaves.
3. Your Business Data and Your Customers
As a Tenant, you may enter, upload, or otherwise submit data into the Service, including customer names and contact details, device/serial/IMEI information, job descriptions, pricing, technician assignments, and file attachments or photographs relating to a job card ("Tenant Data").
You retain all rights to your Tenant Data. We do not claim ownership over it.
You are solely responsible for the accuracy, legality, and appropriateness of Tenant Data you submit, and for obtaining any consents required from your own customers before entering their information into the Service.
You grant us a limited license to host, process, transmit, and display Tenant Data solely to provide, maintain, and support the Service to you.
You must not upload Tenant Data that you do not have the right to share, or that infringes the rights of any third party, or that violates applicable law (including data protection law that applies to your own customers' personal information).
4. Subscriptions, Trials and Payment
Access to some or all features of the Service may require a paid subscription. Applicable fees, billing cycle, and renewal terms will be presented to you at signup or upon subscription and are incorporated into these Terms by reference.
Subscriptions renew automatically unless cancelled before the renewal date, unless stated otherwise at signup.
Fees are non-refundable except where required by law or expressly stated otherwise.
We may suspend or limit access to the Service if payment is not received when due, after reasonable notice.
We may change our pricing prospectively, with notice to active Tenants before the change takes effect on their next billing cycle.
5. Acceptable Use
You agree not to:
use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law;
attempt to gain unauthorized access to another Tenant's data or to any part of the Service's infrastructure;
probe, scan, or test the vulnerability of the Service, or circumvent any security or authentication measures;
upload viruses, malware, or any code intended to disrupt or damage the Service;
scrape, reverse-engineer, decompile, or resell the Service or access it via unauthorized automated means;
use the Service to store or transmit content that is defamatory, obscene, infringing, or otherwise unlawful.
We may investigate and take appropriate action, including suspension or termination of accounts, against anyone who violates this section.
6. Mobile Application
The JobCardd companion mobile application connects to the same account and Tenant Data as the website, via the JobCardd API. By installing and using the mobile app you also agree to these Terms.
The mobile app may request device permissions (for example, camera or photo storage access) to support features such as attaching photographs to a job card, and notification permissions to deliver job or account alerts. You can manage these permissions through your device settings; disabling a permission may limit related features.
We may release updates to the mobile app from time to time. Continued use of the app after an update constitutes acceptance of any changes to functionality described in the update notes.
The mobile app is distributed through Google Play (and, where applicable, other app stores) and your use is also subject to the terms of that store.
7. Intellectual Property
The Service, including its software, design, text, graphics, logos, and the "JobCardd" name and marks, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted under these Terms, no other rights are granted to you.
8. Third-Party Services
The Service may integrate with or link to third-party services (for example, hosting, storage, email delivery, or push-notification providers) necessary to operate the Service. We are not responsible for the practices or content of third-party services, which are governed by their own terms.
9. Suspension and Termination
You may stop using the Service and request account/data deletion at any time by contacting us at the address below, subject to any minimum retention required by law or our own record-keeping obligations.
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, misused the Service, failed to pay applicable fees, or if required to do so by law.
Upon termination, your right to use the Service ends immediately. We may retain or delete Tenant Data in accordance with our data retention practices described in the Privacy Policy, and may provide a reasonable opportunity to export Tenant Data before deletion where feasible.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT ANY DATA LOSS WILL NOT OCCUR.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIMETAAG SOFTWARE PVT LTD AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Timetaag Software Pvt Ltd and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Tenant Data, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
13. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which forms part of these Terms.
14. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to its conflict-of-law principles. Subject to applicable law, the courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
16. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy and any order/subscription terms presented at signup, constitute the entire agreement between you and us regarding the Service.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
No Waiver: Our failure to enforce any right or provision will not be considered a waiver of that right.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
